The Biometric Information Privacy Act (BIPA) requirements apply to any private entity collecting, storing, or transmitting biometric information and doing business in the state of Illinois to comply with requirements on the collection and storage of biometric information. Illinois became the first state to begin regulating biometric data for privacy protection with measures including:
- all private organizations must have an individual's permission before collecting their biometric information
- all biometric information collected must be stored in a secure manner
- all biometric information no longer needed must be deleted in a timely manner
